1. ACCEPTANCE OF TERMS

By submitting your assessment or accessing this report, you ("User", "You", "Your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this service.

2. NATURE OF SERVICE

2.1 What We Provide

Orobo Healthcare Ltd ("we," "us," "our") provides predictive assessment services to help care homes prepare for Care Quality Commission (CQC) inspections. Our service:

  • Collects responses to care quality questions
  • Analyses your responses using our proprietary methodology
  • Analyses assessment responses and available data
  • Generates estimated predictions of potential inspection outcomes
  • Identifies areas that may require attention

2.2 What This Is NOT

  • An official CQC inspection, rating, or determination
  • A guarantee of future inspection outcomes
  • A definitive assessment of care quality
  • A binding prediction
  • Affiliated with, endorsed by, or representing the Care Quality Commission
  • A substitute for professional compliance advice
  • A replacement for your ongoing compliance obligations

3. PREDICTIONS ARE ESTIMATES, NOT GUARANTEES

3.1 Nature of Predictions

All predictions, scores, ratings, confidence levels, and assessments provided through our service are ESTIMATES ONLY. They are not guarantees of actual CQC inspection outcomes. Actual results may differ significantly from our predictions.

3.2 What Our Predictions Are Based On

Our predictions are based on:

  • Your assessment responses
  • Available CQC historical data
  • Statistical modelling
  • Industry patterns

3.3 Factors We CANNOT Account For

However, we CANNOT account for:

  • Specific inspector observations on inspection day
  • Particular questions inspectors choose to ask
  • Documentation available at time of inspection
  • Changes in your care home after assessment
  • External circumstances affecting the inspection
  • Inspectors' subjective judgements
  • Differences between self-reported and actual conditions

These unmeasurable factors mean actual outcomes may vary from predictions.

4. CONFIDENCE SCORES EXPLAINED

Our confidence scores (e.g., "65% confidence", "85% confidence") indicate the relative reliability of predictions based on available data:

  • Higher confidence = narrower prediction range
  • Lower confidence = wider prediction range
  • Higher confidence does NOT equal guaranteed accuracy
  • Lower confidence does NOT mean the prediction is wrong
  • Confidence ranges acknowledge inherent uncertainty

Even with 85% confidence, actual outcomes may fall outside the predicted range approximately 15% of the time.

5. DATA ACCURACY & USER REPRESENTATIONS

5.1 Your Responses

By using this service, you represent that:

  • Your responses are truthful and accurate to the best of your knowledge
  • You have authority to provide information about the care home
  • You understand that inaccurate responses may affect prediction reliability

5.2 CQC Data Verification

  • We may verify self-reported ratings against official CQC data
  • Discrepancies may affect prediction confidence
  • We reserve the right to correct inaccurate information
  • Verification improves prediction reliability but does not guarantee outcomes

5.3 "Garbage In, Garbage Out"

The quality of predictions depends entirely on the quality of your responses. Inaccurate or incomplete data will lead to less reliable outcomes.

6. NO AFFILIATION WITH CQC

We are NOT:

  • Part of the Care Quality Commission
  • Endorsed by the Care Quality Commission
  • Authorised to speak for the Care Quality Commission
  • Able to influence actual CQC inspections or ratings

We are an independent company providing predictive analytics and consulting services.

7. NOT PROFESSIONAL ADVICE

Our service does NOT constitute:

  • Professional compliance consulting (unless explicitly purchased)
  • Legal advice
  • Financial advice
  • Medical or healthcare advice
  • Official regulatory guidance
  • A substitute for professional consultation

8. YOUR RESPONSIBILITY

You remain SOLELY RESPONSIBLE for:

Our predictions should inform your efforts, not replace them.

9. INTELLECTUAL PROPERTY

All methodologies, scoring systems, and report formats are our intellectual property. You retain ownership of your data but grant us permission to process, anonymise, and store it per our Privacy Policy.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We provide this service "AS IS" without warranties of any kind. We are NOT LIABLE for any damages whatsoever arising from:

  • Inaccurate predictions
  • Reliance on predictions
  • Business decisions based on predictions
  • Regulatory consequences
  • Lost opportunities
  • Reputational harm
  • Business, regulatory, or reputational losses
  • Any indirect, consequential, or incidental damages

Our maximum liability, if any, shall not exceed the amount you paid for the service (£0 for the free assessment).

11. USE AT YOUR OWN RISK

By using our service, you acknowledge and accept that:

  • Predictions may be inaccurate
  • Actual CQC results may differ materially from predictions
  • You remain responsible for compliance

These Terms are governed by the laws of England and Wales. You agree to the exclusive jurisdiction of English courts.
